Misuse of Bank Cards and There Punishments (A Comparative Study in the Light of Shariah and Law)

Abstract

Goodness and evilness, happiness and sadness, crime and punishment are closely related, one is inseparable from the other. Just as good deeds are rewarded and respected, so is wrongdoing. While on the one hand banks and financial institutions encourage the use of bank cards by highlighting their benefits, it is also necessary to warn the members of the society against misuse of bank cards. This should be highlighted and people should be warned so that they will not only avoid misuse of the card but also become a means and cause to save other members of the society.

In this article, a comparative analysis has been presented not only legally, but also Shariah explaining the same sense of guilt and punishment aspect of accountability related to different types of cards issued by the banks. So that it can be clear from both aspects of Sharia and Law, what are the common forms of these different types of misuse of cards and what are their punishments in the context of Sharia and Law.  So that keeping in view these concepts, such crimes can be prevented, self-protection can be done and the society can be cleansed from vices like theft and misuse of cards.

Additionally, this study will play a key role in preventing this evil and similar evils.  It will also be an addition in the literature base and will be helpful for the judges, jurists, scholars and law enforcement agencies in their respective spheres.
